Definition of Compliance Year

For Attorneys Licensed 2 or More Years

Your MCLE compliance year is a one-year period that begins on the first day of the month you were born.

It ends one year later on the last day of the month that precedes your birth month.

Each attorney has an automatic grace period, the end of his or her birth month, in which to complete and report MCLE hours for that compliance year. All CLE must be completed and reported (received by the MCLE Director) by the last day of the birth month in order to avoid a non-compliance penalty fee.

For Newly-Licensed Attorneys (Initial Compliance Year Calculation)

If you are a newly-licensed attorney, your initial MCLE compliance year is a 24-month period. It begins on the first day of the month you were born, after the date you are licensed.

It ends two years later, on the last day of the month that immediately precedes the month you were born.

Newly-licensed attorneys may also claim MCLE credit for accredited CLE completed one year prior to the beginning date of the initial compliance year.

Each attorney has an automatic grace period until the end of his or her birth month, in which to complete and report MCLE hours for that compliance year. All CLE must be completed and reported (received by the MCLE Director) by the last day of the birth month in order to avoid a non-compliance penalty fee.

For Attorneys 70 Years Old or Older

The Texas Supreme Court issued an order dated April 28, 2015, that amends Article XII of the State Bar Rules to eliminate the MCLE exemption for emeritus attorneys. Beginning June 1, 2016, emeritus members will be required to comply with MCLE requirements. Members who turn 70 on or after June 1, 2016, will continue to comply with MCLE requirements each year as usual.
