In 2017, the Texas Legislature amended Chapter 81 of the Government Code to create the Committee on Disciplinary Rules and Referenda (CDRR) and to overhaul the disciplinary rule proposal process. Under the new process, a proposed rule must be approved by the CDRR, the State Bar Board of Directors, State Bar membership, and the Supreme Court of Texas.
In 2021, the first referendum under this new process was conducted. Eight rule proposals were approved by State Bar of Texas members. Click here to view results on the 2021 referendum.
Between 2021 and 2023, the board approved 12 rule proposals recommended by the CDRR. The CDRR previously published each proposal for public comment and held public hearings on the proposals.
On September 29, 2023, the board voted to petition the Supreme Court for a referendum on the rule proposals. The Supreme Court ordered a referendum on October 6, 2023. Click here to see the order.
The 2024 rules vote referendum will be held in conjunction with the State Bar/TYLA president-elect and district director elections. Voting begins on April 1, 2024 and ends at 5 p.m. CDT on April 30, 2024.
