State Bar of Texas Statement Regarding Allegations Against the Attorney Disciplinary System

State Bar of Texas President Sylvia Borunda Firth issued the following statement Friday:

“As an administrative arm of the Texas Supreme Court, the State Bar of Texas is dedicated to fostering ethical conduct in the legal profession and protecting the public through the attorney discipline system. The system is governed by the Texas Disciplinary Rules of Professional Conduct and the Texas Rules of Disciplinary Procedure. The ethics rules define proper conduct for purposes of professional discipline. The procedural rules provide the mechanism by which grievances are processed, investigated, and prosecuted.

“The system is designed to ensure fairness to all parties. Partisan political considerations play no role in determining whether to pursue a grievance or how that grievance proceeds through the system. Any claims to the contrary are untrue.

“The Commission for Lawyer Discipline, a 12-person volunteer standing committee (with an equal number of public and attorney members) provides oversight to the chief disciplinary counsel, which administers the attorney discipline system with help from volunteer grievance panels located across Texas. Grievance committee members are trained to make two determinations: Did the attorney violate the Texas Disciplinary Rules of Professional Conduct and, if so, what sanction is appropriate?

“These unpaid volunteers devote countless hours to hearing and considering cases to ensure attorneys are fulfilling their obligations to the public. Without them, the attorney discipline system could not function. We are grateful for their service.”
