Steps for Certification

Complete the below steps for eligibility for attorney ad litem appointment in Texas Courts under Tx. Estates Code, Subchapter E, Sec. 1054.201-203.  

  1. COMPLETE an accredited training course for guardianship ad litem.

    • Search for a class in the CLE database by clicking here and searching “ad litem” in the course title field.

    • Some tapes and DVDs are approved for self-study.

  1. PRINT out the declaration.

  1. SEND the completed declaration and $25 payment to the MCLE Department.

    • To apply by mail: Mail the completed affidavit, including a check made out to the “State Bar of Texas” for $25, to the MCLE Department (address below).

    • To apply by email: Email the MCLE Department at mcle@texasbar.com to add the $25 processing fee to your My Bar Page account. After the fee is paid, email the completed affidavit to MCLE.

When the declaration and payment are received, the guardianship certificate will be emailed to the attorney. The attorney will also be added to the database of ad litem lawyers.

FAQs

Is Guardianship Certification a function of the MCLE Department?
The MCLE Department keeps records of certified attorneys, but certification is not an MCLE function. However, ad litem certification training is approved for MCLE credit and can be used toward MCLE compliance.

How long is the certification period?
The initial certification is a two-year period beginning on the date the course was completed. Attorneys can receive a four-year certificate after being certified for two consecutive two-year terms.

Which courses qualify for Guardianship Certification?
Approved training courses meet the requirements outlined in Tex. Govt. Code §81.114. Sponsors should provide a written request to the MCLE Director to review the course for guardianship approval.

Are there self-study tapes/DVDs available for completing the training?
Yes, local bars often keep a library of guardianship courses. Or, visit TexasBarCLE to access courses.
