Guardianship Ad Litem In Probate Court Certification and Renewal Processing

The following information outlines the process to become eligible to be appointed an attorney ad litem in Texas Courts under Chapter XIII, Texas Probate Code.

  1. An attorney must complete a State Bar approved training course. (see course search below)
  2. Once the approved training is completed the attorney will receive an affidavit from the MCLE Department.
  3. The affidavit should be completed, notarized and mailed to the MCLE Department along with a check payable to the 'State Bar of Texas' in the amount of $25.
  4. Once MCLE has received the affidavit, a certificate will be mailed or emailed to the attorney.
  5. The attorney will be certified for an initial two (2) year period. Once the attorney has been certified for two (2) consecutive two year periods, the attorney will then be certified for four (4) years. (see Probate Code, Sect 647 A (e)).

Questions regarding Guardianship Certification or renewal should be directed to the MCLE department at (800) 204-2222, Ext. 1806 or email MCLE@texasbar.com.

Guardianship Certification FAQ's

Is Guardianship certification a function of MCLE?
The MCLE Department keeps records of certified attorneys but certification is not a function of the MCLE program. Ad litem certification training is approved for MCLE credit and can be used toward MCLE compliance.

How long is the certification period?
The initial certification period is two a year period beginning on the date of issuance of the certificate. An attorney can receive a four year certificate once he/she has been certified for two consecutive two year terms.

What training courses qualify for Guardianship Certification?
Approved training courses meet the requirement outlined in Section 81.114 of the State Bar Act. Sponsors of training courses should request review and approved by writing to the Director of MCLE.

Are there self-study tapes/DVDs available for completing the training?
Yes. You can check with your local county bar association or with Texas Bar CLE.

How can I found out if there are any approved programs available for attorneys to attend?
(Need new link to new guardianship course search)

Can an attorney fax an affidavit of completion to receive a certificate?
No. The Start Bar requires an original signature on the affidavit.
